1. Purpose and Identification
This document (General Terms and Conditions of Sale) sets out the terms and conditions applicable to sales concluded between, on the one hand, individuals wishing to make a purchase via the MEDUSE website https://www.meduse.com/ (hereinafter referred to as "the customer") and, on the other hand, the company HUMEAU BEAUPREAU SAS, with a capital of €737,344, whose registered office is located at 80 Rue des Forges, Beaupréau, 49600 Beaupréau en Mauges, France, registered with the Angers Trade and Companies Register under number 393 092 390, hereinafter referred to as "MEDUSE".

These conditions apply only to non-commercial natural persons who are considered consumers under Regulation (EU) No 1215/2012 of the European Parliament, Section 4, Article 17.

2. Order
The Customer can place an order online via the website https://www.meduse.com/. Placing an order implies irrevocable acceptance of these general terms and conditions of sale. These terms and conditions may be subject to changes, and the terms applicable will be those in force on the site https://www.meduse.com/ on the date of the order. The order will only be recorded on the site if the user has clearly identified themselves by entering their customer code (which corresponds to their email) and a password. Orders are only considered valid after payment acceptance. After payment acceptance, MEDUSE will confirm the order to the Customer via email, assigning a number to the order.

3. Product Availability
Any order implies acceptance of the prices and description of the products available for sale.

MEDUSE commits to honoring orders placed on the website only within the limits of available stock. In case of unavailability of one or more ordered products, MEDUSE will inform the customer as soon as possible. The customer’s order will then be automatically canceled, either in whole or in part, and their credit card will be re-credited for the amount of the canceled order or returned product(s).

4. Delivery
Delivery is made according to the provisions mentioned below, depending on the delivery zone chosen by the Customer.

Any order placed on the MEDUSE website before 11:00 AM from Monday to Thursday (except on public holidays) will be processed and shipped within 48 hours, provided that payment is validated (see paragraph 5. Payment). Orders placed on Fridays, Saturdays, Sundays, or public holidays (except Ascension holidays) will be processed on the next business day.

No partial deliveries will be made.

4.1. Delivery in Metropolitan France and Corsica (Zone 1)
The Customer may choose from the following paid delivery options:

  • Chronopost with 2 options:

    • Express home delivery by 6 PM the next day (if the order is placed before 11 AM)

    • Delivery to a pick-up point; free delivery on orders over €70.

4.2. Delivery within Europe and Outside Europe
European Countries
The Customer may choose from the following paid delivery options:

  • Chronopost delivery to a pick-up point: €15.00 VAT included for parcels up to 2 kg, €20.00 VAT included for parcels up to 5 kg; for parcels over 5 kg, the DHL option must be chosen.

  • DHL home or pick-up point delivery within 4 to 5 days: €25.00 VAT included for parcels up to 5 kg, €30.00 VAT included for parcels up to 10 kg, €40.00 VAT included for parcels up to 15 kg; for parcels over 15 kg, the customer must contact MEDUSE for the exact transport cost.

Non-European Countries

  • DHL home or pick-up point delivery within 4 to 5 days: €25.00 VAT included for parcels up to 5 kg, €30.00 VAT included for parcels up to 10 kg, €40.00 VAT included for parcels up to 15 kg; for parcels over 15 kg, the customer must contact MEDUSE for the exact transport cost.

Attention:
Customs duties or other taxes or import duties may apply when the products enter the customer's country of residence. These duties and taxes are not the responsibility of MEDUSE. The Customer must inform themselves about the obligations of the relevant legislation and regulations and fulfill any required declarations or payments.

5. Payment
Payment for purchases is made by credit card: Visa, MasterCard, Eurocard MasterCard, Apple Pay, or Paypal, secured by 3D Secure.

6. Right of Withdrawal
Under Article L.121-21 of the Consumer Code, the Customer has 14 days to exercise their right of withdrawal without needing to justify any reason. The period starts from the day the customer receives the confirmation of the order. If the 14-day period expires on a Saturday, Sunday, or public holiday, it is extended until the next business day.

To exercise the right of withdrawal, the Customer must notify MEDUSE of their decision to withdraw before the period expires. The withdrawal form can be accessed via a simple click on the provided link.

7. Returns
7.1. Return Period
The Customer has 15 working days from the date of receipt of the goods to return any item that does not meet their satisfaction, provided that the conditions below are respected.

7.2. Return Conditions
Refunds are the only option available for returns. Fill out the return slip provided with the order and include it in the package before returning it to: HUMEAU BEAUPREAU, meduse.com, 80 Rue des Forges, Beaupréau, 49600 Beaupréau en Mauges, France.

7.3. Condition of Products
All returned products (shoes, original packaging, accessories, instructions, etc.) must be unused, in their original packaging, and without any markings. If the products are visibly used or damaged due to the customer's actions, returns will not be accepted.

7.4. Refund
If the return complies with the conditions mentioned above, MEDUSE will refund the returned items within 15 days of receiving the returned goods. The original shipping costs will not be refunded unless the return is due to non-compliance or an error on MEDUSE's part.

7.5. Legal Warranties
The products benefit from the legal warranty of conformity (Articles L.217-1 to L.217-32 of the Consumer Code) and the warranty for hidden defects (Articles 1641 and following of the Civil Code).

8. Price
MEDUSE reserves the right to modify prices on the website at any time without prior notice.

9. Transaction Security
MEDUSE implements all measures to ensure the confidentiality and security of data transmitted on the web and through the website https://www.meduse.com/.

10. Intellectual Property
All elements of the MEDUSE website, whether visual or audio, are protected by copyright, trademarks, or patents. HUMEAU BEAUPREAU SAS owns or has contractual rights to exploit these elements. Only private use is allowed unless otherwise stated in the Intellectual Property Code.

11. Personal Data
All personal data collected by HUMEAU BEAUPREAU SAS will be processed in accordance with the European Regulation No. 2016/679 (General Data Protection Regulation, GDPR).

12. Liability
HUMEAU BEAUPREAU is not responsible for any inconvenience or damage caused by the use of the internet, such as service disruptions, external intrusions, or the presence of computer viruses.

13. Entirety
If any clause of these Terms and Conditions is found to be void or invalid due to a change in legislation or a court decision, this does not affect the validity or enforcement of the other clauses.

14. Duration
These terms apply for the entire duration of the services offered by MEDUSE.

15. Proof
Electronic records, stored in MEDUSE’s and its partners' computer systems under reasonable security conditions, will serve as proof of communication, orders, and payments between the parties.

16. Archiving
Order forms and invoices are archived on a reliable and durable medium to ensure faithful and lasting copies as per Article 1348 of the Civil Code.

17. Dispute Resolution

  • Applicable Law: If the customer is French, French law will apply.

  • Procedure and Competence: Disputes may be submitted to the online dispute resolution platform at ec.europa.eu/consumers/odr.

  • Consumer Mediation: In case of a dispute, the consumer may contact the Association des Médiateurs Européens (AME CONSO).
